TrainTak is an independent travel agency and authorized reseller of rail tickets, operating from 334 Beyer's Bay, Houston, US 19839. In these terms, “TrainTak”, “we” and “us” refer to that business; “you” refers to the person making or holding a booking.

TrainTak is not a railroad and does not operate any train service. We are not owned, operated or endorsed by any rail carrier. We act as an intermediary between you and the carrier: we sell and service the ticket, the carrier operates the train.

By browsing TrainTak, creating an account or completing a booking, you accept these terms, our Privacy Policy, our Refund & Cancellation Policy and the fare rules shown at the time of purchase. If you do not accept them, please do not use the service.

You must be at least 18 years old to make a booking. If you book for other travellers, you confirm you are authorized to accept these terms on their behalf and that the details you give us for them are accurate.

A booking is only confirmed once we have received full payment and issued you a confirmation containing a reservation number. A search result, a held fare or an on-screen quote is not a confirmed booking and does not guarantee availability or price.

• Names on a ticket must match the government-issued photo ID the traveller will carry.
• Fares, schedules, routings, seating and onboard services are set and operated by the rail carrier and may change.
• Some fares are restricted: they may be non-refundable, non-changeable, or carry a fee to modify. The restrictions are shown before you pay.
• Tickets are issued for the named traveller and may not be resold or transferred to another person.

If a fare becomes unavailable or is withdrawn by the carrier between your request and ticketing, we will contact you with the options available and, where you do not wish to proceed, refund you in full.

All prices are shown in the currency selected on site and include the carrier’s fare plus any TrainTak service fee, which is itemised before payment. We do not add charges at the payment step that were not disclosed on the review page.

• Payment is taken at the time of booking using the card or payment method you provide.
• Your bank or card issuer may apply a foreign-transaction or currency-conversion charge that is outside our control.
• Where a price is displayed in a currency other than US dollars, it is an indicative conversion; the amount charged may differ slightly.
• We reserve the right to cancel a booking where payment is declined, reversed or suspected to be fraudulent.

Obvious pricing errors — a fare published at a clearly incorrect amount because of a technical or human fault — do not bind us. If one affects your booking we will tell you promptly and offer either the corrected price or a full refund.

Changes and cancellations are governed by the fare rules attached to your ticket and by our Refund & Cancellation Policy, which forms part of these terms. In summary: refundable fares can be cancelled for a refund to the original payment method, value fares may be refunded as travel credit, and the most restricted saver fares may not be refundable at all.

Where the carrier cancels a service, or delays it beyond the thresholds it publishes, your entitlement is set by the carrier’s own conditions of carriage. We will help you claim it and will refund any TrainTak service fee where the failure was not your doing.

You are responsible for arriving at the station in time to board, for carrying valid identification, and for any documentation required for your journey. Missed departures caused by late arrival are treated as a no-show under the applicable fare rules.

Onboard conduct, baggage allowances, carriage of pets, and accessibility arrangements are governed by the carrier’s rules. A carrier may refuse carriage where those rules are not met, andTrainTak has no authority to override that decision.

You are responsible for keeping your account credentials confidential and for activity that takes place under your account. Tell us immediately if you believe it has been used without your permission.

We may suspend or close an account that is being used to abuse fare rules, to make speculative or fraudulent bookings, or in a way that harms other customers or our service.

• Do not scrape, crawl, harvest or systematically extract fares, schedules or content from TrainTak.
• Do not attempt to probe, disrupt or gain unauthorized access to our systems or another customer's data.
• Do not use automated tools to make, hold or cancel bookings.
• Do not reproduce TrainTak branding, page designs or content without our written permission.

TrainTak is liable for the booking service it provides: issuing the correct ticket, charging the correct amount, and servicing your reservation with reasonable care and skill. Where we fail in that, we will put it right.

We are not the carrier, and we are not liable for the operation of the train — including delay, cancellation, equipment substitution, onboard service, missed connections, or loss of or damage to baggage. Those are the carrier’s responsibility under its conditions of carriage.

To the extent permitted by law, our total liability arising from a booking is limited to the total amount you paid to TrainTak for that booking. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

We strongly recommend travel insurance covering cancellation, medical expenses, delay and baggage. Restricted fares in particular carry real financial risk if your plans change, and insurance is usually the only way to recover that cost.

These terms are governed by the laws of the Commonwealth of Pennsylvania and the United States, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Philadelphia County, Pennsylvania.

We may update these terms to reflect changes in our service or in the law. The version that applies to your booking is the one published when the booking was confirmed. Material changes will be announced on this page, and the “last updated” date above will always tell you when the current version took effect.
